Deficiency of intellect in the Access to Justice Act 1999 - he did the opposite - access FROM Justice and he could not provide "equality". The reason he could not provide equality is because "the parties decide" 30:70; 60:40; 99:1 albeit possibly 50:50 "contemporary equality" in a mediation. Only traditional equality can be provided by a judge, because the judge places the parties in a position of equality before the law.
